2. CHARAKTER USŁUG

RJ Performance świadczy usługi związane z:

Wyniki tuningów, pomiary mocy, osiągi oraz parametry spalania mają charakter orientacyjny i mogą różnić się w zależności od:

3. RYZYKO ZWIĄZANE Z MODYFIKACJAMI

Klient przyjmuje do wiadomości, że wszelkie modyfikacje pojazdu mogą:

zwiększać obciążenie podzespołów mechanicznych,

wpływać na trwałość silnika i układu napędowego,

wpływać na zużycie sprzęgła, skrzyni biegów, turbosprężarki i innych elementów eksploatacyjnych,

skutkować utratą gwarancji producenta,

powodować niezgodność pojazdu z przepisami obowiązującymi w niektórych krajach.

Klient ponosi pełną odpowiedzialność za dalsze użytkowanie pojazdu po wykonaniu modyfikacji.

4. LEGALNOŚĆ UŻYTKOWANIA POJAZDU

RJ Performance nie ponosi odpowiedzialności za legalność użytkowania pojazdu po wykonaniu modyfikacji.

Obowiązek sprawdzenia zgodności pojazdu z:

RJ Performance nie ponosi odpowiedzialności za błędy lub ograniczenia wynikające z oprogramowania producenta pojazdu.

Maksymalna odpowiedzialność RJ Performance ograniczona jest wyłącznie do wartości wykonanej usługi.

7. STAN TECHNICZNY POJAZDU

Klient oświadcza, że pojazd przekazany do wykonania usługi:

posiada odpowiedni poziom płynów eksploatacyjnych.

Klient zobowiązuje się poinformować RJ Performance o:

modyfikacjach wykonanych przez inne podmioty.

RJ Performance ma prawo odmówić wykonania usługi w przypadku stwierdzenia ryzyka uszkodzenia pojazdu lub zagrożenia bezpieczeństwa.

8. DANE I OPROGRAMOWANIE

RJ Performance może wykonywać:

8.1. INDYWIDUALNE OPROGRAMOWANIE I BRAK PRAWA DO ZWROTU

Każda modyfikacja oprogramowania (mapa ECU/TCU) przygotowywana przez RJ Performance jest tworzona indywidualnie dla konkretnego pojazdu, z uwzględnieniem jego specyfikacji technicznej, stanu oraz zakresu uzgodnionych modyfikacji. Usługa ma charakter spersonalizowany i nie stanowi produktu gotowego.

Z uwagi na indywidualny charakter wykonanej usługi oraz fakt, że po zapisaniu zmodyfikowanego oprogramowania w pojeździe klient uzyskuje możliwość korzystania z efektów wykonanej pracy, usługa nie podlega zwrotowi ani odstąpieniu od umowy po jej wykonaniu, chyba że bezwzględnie obowiązujące przepisy prawa stanowią inaczej.

Powyższe wynika również z konieczności ochrony własności intelektualnej RJ Performance. Po opuszczeniu przez pojazd siedziby RJ Performance lub po przekazaniu zmodyfikowanego oprogramowania istnieje możliwość odczytania i skopiowania przygotowanej mapy, co uniemożliwia skuteczne cofnięcie skutków wykonanej usługi i mogłoby prowadzić do nieuprawnionego wykorzystania opracowanego oprogramowania.

9. STRONA INTERNETOWA

Informacje publikowane na stronie internetowej mają charakter wyłącznie informacyjny i nie stanowią wiążącej oferty handlowej.

RJ Performance dokłada wszelkich starań, aby informacje były aktualne i poprawne, jednak nie gwarantuje:

8. DATA AND SOFTWARE

8.1. CUSTOM SOFTWARE AND NO RIGHT OF RETURN

Each ECU/TCU software modification provided by RJ Performance is individually developed and calibrated for a specific vehicle, taking into account its technical specifications, condition, and the agreed scope of modifications. The service constitutes a personalized digital service and is not a standard off-the-shelf product.

Due to the custom nature of the service and the fact that the customer receives the benefit of the modified software once it has been installed in the vehicle, the completed service is non-refundable and may not be cancelled after completion, unless mandatory applicable law provides otherwise.

This policy also serves to protect the intellectual property of RJ Performance. Once the vehicle has left the RJ Performance premises or the modified software has been delivered, the software may be read, copied, or reproduced using specialized equipment, making it impossible to effectively reverse the service and creating a risk of unauthorized use or duplication of RJ Performance’s proprietary calibration files.

9. WEBSITE

Information published on the website is for informational purposes only and does not constitute a binding commercial offer.

slijtage van koppeling, versnellingsbak, turbo en andere onderdelen kunnen beïnvloeden,

invloed kunnen hebben op emissiewaarden,

invloed kunnen hebben op de voertuiggoedkeuring,

kunnen leiden tot verlies van fabrieksgarantie,

kunnen leiden tot niet-naleving van regelgeving in bepaalde landen.

De klant draagt volledige verantwoordelijkheid voor het verdere gebruik van het voertuig na modificatie.

4. LEGALITEIT VAN HET GEBRUIK VAN HET VOERTUIG

RJ Performance is niet verantwoordelijk voor de legaliteit van het gebruik van het voertuig na modificatie.

De verplichting om te controleren of het voertuig voldoet aan:

RJ Performance is niet aansprakelijk voor fouten of beperkingen die voortvloeien uit software van de voertuigfabrikant.

De maximale aansprakelijkheid van RJ Performance is beperkt tot de waarde van de uitgevoerde dienst.

7. TECHNISCHE STAAT VAN HET VOERTUIG

De klant verklaart dat het voertuig dat voor service wordt aangeboden:

geschikt is voor de uitvoering van de dienst,

beschikt over voldoende bedrijfsstoffen.

De klant verplicht zich RJ Performance te informeren over:

modificaties uitgevoerd door derden.

RJ Performance behoudt zich het recht voor om een dienst te weigeren indien er risico bestaat op schade aan het voertuig of veiligheidsproblemen.

8. GEGEVENS EN SOFTWARE

RJ Performance kan uitvoeren:

updates van controllers,

aanpassingen van motormappen.

Ondanks de grootst mogelijke zorg bestaat er risico op:

De klant accepteert de risico’s die gepaard gaan met ingrepen in de voertuigelektronica.

RJ Performance is niet verantwoordelijk voor eerdere ongeautoriseerde softwaremodificaties uitgevoerd door derden.

8.1. MAATWERKSOFTWARE EN GEEN RECHT OP TERUGBETALING

Elke ECU/TCU-softwareaanpassing die door RJ Performance wordt uitgevoerd, wordt individueel ontwikkeld en afgestemd op een specifiek voertuig, rekening houdend met de technische specificaties, de staat van het voertuig en de overeengekomen werkzaamheden. De dienst betreft maatwerk en is geen standaardproduct.

Vanwege het gepersonaliseerde karakter van de dienst en het feit dat de klant direct profiteert van de aangepaste software zodra deze in het voertuig is geïnstalleerd, komt de uitgevoerde dienst na voltooiing niet in aanmerking voor terugbetaling of ontbinding, tenzij dwingend toepasselijk recht anders bepaalt.

Dit beleid dient tevens ter bescherming van de intellectuele eigendomsrechten van RJ Performance. Nadat het voertuig het bedrijf van RJ Performance heeft verlaten of de aangepaste software is geleverd, kan deze met gespecialiseerde apparatuur worden uitgelezen, gekopieerd of opnieuw worden gebruikt. Hierdoor is het niet mogelijk de uitgevoerde dienst ongedaan te maken en bestaat het risico op ongeoorloofde reproductie of hergebruik van de door RJ Performance ontwikkelde software.

9. WEBSITE

De informatie op de website is uitsluitend informatief en vormt geen bindend commercieel aanbod.

RJ Performance doet haar uiterste best om informatie actueel en correct te houden, maar garandeert niet:
